Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No one shall use a trademark identical or similar to another person's registered trademark on goods identical or similar to the designated goods, and among the facts charged of the act of causing confusion with another person's goods by using a trademark identical or similar to another person's name, trade name, trademark, container or package of goods, or any other mark widely known in the Republic of Korea, or by selling, distributing, importing, or exporting goods using such a mark, this part of the facts charged contains an act falling under Article 2 subparagraph 1 (b) of the Unfair Competition Prevention and Trade Secret Protection Act. Although Article 2 subparagraph 1 (b) of the same Act is also stated in the applicable law, the part of the defendant's act of Article 2 subparagraph 2 of the facts charged is stated in Article 2 subparagraph 1 (b) of the same Act, and thus, the part of the defendant

shall not be subject to any provision of this section.

1. 상표법위반 피고인은 2017. 2. 1. 경 인천 남구 C 1 층에 있는 D 백화점 매장 내에서 상표권 자인 주식회사 장수산업이 전기 돌침대 등을 지정상품으로 하여 특허청에 제 0524178호로 상표 등록한 ‘ 장수 온돌’, 제 0543523호로 상표 등록한 ‘ 장수★★★★★’, 제 0990409호로 상표 등록한 ‘ 장수 돌침대’ 와 유사한 ‘E, 제조원 ( 주) F’, ‘G ’라고 표시되어 있는 침대를 전시, 판매하여 상표권을 침해하였다.

The Defendant, in violation of the Unfair Competition Prevention and Trade Secret Protection Act, committed an act that causes multiple unspecified persons to confuse with the goods of the victim by selling a stone ties with signs, such as “E,” “F,” “G,” similar to the date and time indicated in paragraph (1) of the facts charged, and the mark of “ma,” “M,” “F,” and “G,” which are widely known in the Republic of Korea.
