A defendant shall be punished by imprisonment for not more than ten months.

1. Around July 1, 2013, the Defendant made a false statement to the effect that “G office located in F,” “G” would operate a wedding hall with “G” in the name of “G.” On October 2013, the Defendant made it possible for the Defendant to operate the said wedding hall as an exclusive wedding photo officer from October 2013 to December 2015, when the contract term expires.”
However, the Defendant did not have entered into the contract for the construction of the above wedding, and there was no method of preparing the construction cost, and the Defendant did not have any other asset or profit in excess of the debt, and did not have any intent or ability to have the exclusive photographer operate the construction work or return the deposit to the victim on October 2013. Thus, the Defendant received the deposit and used it for the Defendant’s repayment of the existing debt.
The Defendant, by deceiving the victim as such, received KRW 50 million from the victim as part of the deposit money on the same day.

2.
