Punishment of the crime

On December 23, 2011, the Defendant was sentenced to nine months of imprisonment for fraud, etc. at the Seoul Eastern District Court, and completed the execution of the sentence on February 27, 2012.

On December 20, 2012, the Defendant made a false statement to the victim’sO by phone calls from the vehicle trading company at both cities, stating, “If the Defendant purchased a high-priced imported vehicle and then handle it with the high-priced imported vehicle and received insurance proceeds several times to make profits from it, he/she may pay money to allow 5-60,000 won to live a vehicle.”

However, even if the Defendant received money from the victim, the Defendant did not have any intention or ability to pay more money than the money received through the unrepair processing as above.

On December 20, 2012, the Defendant, by deceiving the victim, received 20,000,000 won from the victim to the post office account in the name of P on December 20, 2012, and acquired it by defrauded.

On December 31, 2012, the Defendant made a false statement to the victim’sO at the Yang apartment parking lot located in Seocho-gu, Seocho-gu, Seocho-gu, 2012, stating, “Abenz S500-ro, is doing work using a vehicle, and the spread should be spreaded. When sending KRW 5.3 million, the Defendant once sending it, he/she will repair it with the money.”

However, even if the defendant received money from the victim, the defendant did not have any intention or ability to repair the benz S500 lox vehicle.

On December 31, 2012, the Defendant, by deceiving the victim, received KRW 5,300,000 from the victim to the post office account in the name of P on December 31, 2012, and acquired it by defrauded.

around May 8, 2013, the Defendant: (a) received a request from the victim Q to purchase used cars in order to obtain loans from the victim Q, and (b) completed the registration of the car in the victim’s name, the Defendant completed the car registration of the 24,000,000 won of the market price around May 10, 2013.

The defendant is above the victim.
