1. The Defendant shall, in order to the Plaintiff, each point indicated in the attached Form No. 5, 6, 7, 8, and 5 among the forest land B in Ulsan-gun, Ulsan-gun, 639 square meters.

1. Basic facts

A. Since October 22, 1971, D Forest land No. 25884 square meters in Ulsan-gun, Ulsan-gun, Ulsan-gun was owned E, and the registration of ownership transfer was completed on January 26, 1996, and the registration of ownership transfer was completed on May 20, 2013.

B. Meanwhile, a part of the forest land was divided into a 2584m2 in Ulsan-gun, Ulsan-gun, Ulsan-gun, and became the registration conversion and became the 7120m2 on October 6, 2014, and was divided into the said land and became the 639m2 in B forest land (hereinafter “instant land”).

C. From around 1978, an enzymium corporation (hereinafter “ enzymium”) installed the transmission tower and the transmission line (hereinafter “the transmission tower and the transmission line of this case”) with the consent of land use from E on eight parcels of land, such as the above D Forest, etc.

As of the date of closing argument of this case, the transmission steel tower of this case is installed on the ground level of 24 square meters connected in order to each point of the attached drawing Nos. 5, 6, 7, 8, and 5 among the land of this case.

Around February 4, 1980, enzinium transferred the ownership of the transmission tower and the transmission line to the Defendant.

E. As of the date of closing argument of the instant case, the Defendant managed the transmission tower and the transmission line of the instant case, and possessed the part on which the transmission tower is installed among the instant land.

2. The assertion and judgment

A. The plaintiff alleged by the parties, on the land of this case, that the defendant without title installs and manages the transmission steel tower on the land of this case, seeking removal of the transmission steel tower of this case and delivery of its site. The defendant is an important facility that supplies electricity to major companies within Ulsansan H, and substantial expenses are incurred in the relocation of the transmission tower, and even if the transmission steel tower of this case is not removed, the plaintiff is not affected in using the land of this case.
