1. 피고인들의 공동범행(업무방해) 피고인들은 2015. 5. 30. 22:50경 부산 연제구 G에 있는 피해자 H(여, 43세)이 운영하는 ‘I’ 식당에서, 몇 년 전 피고인 B과 피고인 C이 위 식당에 손님으로 찾아가 술을 마시고 큰소리로 욕설을 하는 등 행패를 부린 일로 더 이상 피해자가 피고인들을 손님으로 받는 것을 거부하는 것에 불만을 품고, 피고인 A는 출입문을 발로 걷어차면서 식당 안으로 들어가 피해자 및 다수의 손님들을 향해 “씨팔년아, 개새끼야, 뭘 쳐다 보노, 눈깔을 파버리까”라고 큰소리로 욕설을 하고, 피고인 C은 이에 가세하여 “이 개새끼들”이라고 큰소리로 욕설을 하면서 이를 만류하는 손님들에게 “이 새끼야 니는 뭐고”라고 시비를 걸고, 피고인 B은 출입문 앞에 서서 안쪽을 향해 “이 씨팔놈들아, 개새끼들아”라며 큰 소리로 욕설을 하는 등 약 15분 동안 행패를 부려 식사를 하던 손님들이 밖으로 나가거나, 식사를 제대로 하지 못하게 하거나, 식당에 손님들이 들어오지 못하게 하였다.
