나. 피고인은 2014. 7. 30. 13:30경 인천 남구 F에 있는 피해자 G(여, 54세) 운영의 H 식당에서 술에 취해 식당 뒷문을 발로 수회 걷어차 그곳에서 식사를 하던 손님들이 쳐다보자 이에 그 손님들에게 “밥이나 쳐 먹지, 뭘 쳐다봐, 이 씨발년놈들아”라고 큰소리로 욕설을 하는 등 소란을 피워 그 식당에서 식사를 하던 손님들이 식당 밖으로 나가게 함으로써 위력으로 피해자의 식당영업 업무를 방해하였다.
