A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

On February 6, 2006, the Defendant was issued a summary order of 1.5 million won by a fine for a violation of the Road Traffic Act at the Busan District Court, and on March 4, 201, issued a summary order of 2 million won by the Changwon District Court as a fine for the same crime.

1. On September 9, 2013, the Defendant was under the influence of alcohol by 0.086% of blood alcohol level without a driver’s license on the violation of the Road Traffic Act (driving without a license) and the Road Traffic Act (driving without a license). On September 9, 2013, the Defendant driven a B-in vehicle at a section of about 700 meters from the 700-meter radius to the front road of the Heo Village Non-U apartment in the same Dong and Dong.

2. At around 01:40 on September 9, 2013, the Defendant: (a) discovered a drunk driving to C, a police officer controlling the Ya Young apartment in front of the Ya Young-dong in the Yadong-dong, Kim Young-dong, and was under investigation at the same time; (b) stated “E” in the vehicle name column of the driver’s name of the driver’s report of the wing driver who was delivered by C while the Defendant was driving as if the Defendant’s birth was the E; and (c) sealed the Defendant’s obstacle on the back of the report; and (d) written “E” in the vehicle name column of the driver’s name of the wing driver’s report issued by F of the police station affiliated with the above police station; and (e) sealed the Defendant’s obstacle to the Defendant; and (e) forged the report and the report on the detection of the wing driver in the name of E, a private document related to the verification of facts without authority.

The Defendant submitted to C, who was unaware of his position, a falsified driver detection report, and submitted to F, who was unaware of the fact, the circumstantial report on the forged driver was submitted to C and exercised it.

3. On October 5, 2013, the Defendant violated the Road Traffic Act (unlicensed driving) from the parking lot of Posco located in the Posco in the Chang-si, Chang-si without a driver’s license on October 5, 2013 to the Grand-si, Kim Jong-si.
