A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On April 23, 2013, the Defendant was driving a C-learning car under the influence of alcohol concentration of about 2 km from the front of the 2km-dong Community Service Center in Seodaemun-gu Seoul, Seoul to the front of the 105-37 Northwest-dong, without obtaining a driver’s license on April 23, 2013, while under the influence of alcohol concentration of 0.056%.

2. On April 23, 2013, at around 00:18, the Defendant: (a) discovered a police officer, who belongs to the Seodaemun-gu Seoul Western Police Station, to be suspected of drunk driving and measured blood alcohol level as stated in paragraph (1) of the above paragraph; (b) discovered the Defendant’s personal information in order to prepare the Defendant’s notice of the control of drunk driving and the circumstantial report on drunk driving; (c) knew that the Defendant’s personal information was asked to the said D while making the Defendant’s personal information so as to make the Defendant’s report on drunk driving; and (d) knew of the fact that the Defendant’s personal information was stated in the notice of the result of the control of drunk driving and the alcohol driver’s circumstantial report; and (e) made the said D enter “E” in the notice of the result of the control of drunk driving; and (e) made the signature and seal of the said D without authority to use the signature and seal of the said driver; and (e) made the said D’s signature to use the “E driver’s name or passenger’s signature.”

In other words, the defendant continued to know the fact to the above D, which includes the above-mentioned signature of the E, and the notice of the result of the drinking driving control, and the record of the drinking driver's circumstantial report, which includes the forged "Driver confirmation column."
