1. The judgment of the first instance, including the conjunctive claim added by this court, shall be modified as follows:

1. Basic facts

A. The Plaintiff (former Mutual Co., Ltd.) is a company aimed at establishing a real estate development plan and selling by proxy, etc., and the Defendant is a housing reconstruction and improvement project association established under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents to implement a housing reconstruction improvement project (hereinafter “instant reconstruction project”) on the land of 29,95 square meters in the old-si Seoul Special Metropolitan City.

B. On November 2013, the Plaintiff entered into a project management service agreement (PM) providing the Defendant with the following services with respect to the instant reconstruction project (hereinafter “instant service agreement”) and set the service cost as KRW 3,000 per square meter per newly constructed total floor area as follows.

The plaintiff under Article 2 (Scope of Services) of the Service Contract for PM (Project Management) (Evidence A) (Scope of Services) shall perform the following duties of PM:

⑴ 시공사 선정에 따른 전반의 기획업무 ⑵ 피고가 필요로 하는 시공사 선정 관련 행정 대행 업무 ⑶ 시공사와의 협의 업무 ⑷ 일반분양에 따른 영업기획, 광고기획사 및 마케팅(분양업체) 대행 용역사의 선정 업무 ⑸ 피고와 관련된 각종 용역업무에 대한 자문(도시정비법에 따른 정비사업전문관리업체의 용역업무에 대한 부분은 제외) ⑹ 기타 사업진행에 필요하다고 판단되어 피고가 요청하는 업무 제5조(용역보수) ⑴ 원고의 용역보수는 신축연면적 ㎡당 3,000원(부가세 별도)으로 한다.

The time of payment of Domen service cost shall be paid in accordance with the following table:

10% in total within 10% in total within 10 days after the public announcement of the opening of the general meeting for management and disposal of 4% within 20% after receipt of permission for the implementation of 2% project within 10 days after the date of the general meeting for the selection of construction works, within 10 days after the completion of sale by 3 members.

C. In approving the implementation of the instant reconstruction project on May 4, 2016, the Gu U.S. Mayor publicly announced the total floor area of the construction of the said project as 96,196.4186 square meters.
