A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On April 6, 2011, the Defendant was sentenced to imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, etc. by the Seoul Western District Court (hereinafter “Seoul Western District Court”) and two years and six months, and completed the execution of the sentence in the official prison on July 26, 2013, and was 12 times with the same larceny power, and was in a state that the Defendant lacks the ability to discern things or make decisions due to a mental retardation disorder.

1. Violation of the Aggravated Punishment Act;

A. On August 13, 2013, at around 07:30 on August 13, 2013, the Defendant: (a) driven a vehicle with an Epoter equivalent to five million won in the market price owned by the victim D, where the Guro-gu Seoul Metropolitan Government C Prize was parked by sticking the keys at the ground parking lot.

B. On August 13, 2013, around 19:30 on August 13, 2013, the Defendant discovered one HH ray vehicle with the market value of KRW 8.9 million owned by the victim G in front of the Eunpyeong-gu Seoul Metropolitan Government, and opened the door of the foregoing vehicle and used the key of the vehicle located on the string, thereby thefting.

C. On August 18, 2013, at around 02:35, the Defendant: (a) committed a theft by driving a vehicle of Kpoter with a key attached to the first floor parking lot located in Eunpyeong-gu Seoul Metropolitan Government I; and (b) the market price of the victim J owned by the victim J, which was parked with a key attached to the first floor parking lot located in Eunpyeong-gu Seoul Metropolitan Government.

Accordingly, the defendant habitually stolen vehicles owned by others three times.

2. Violation of the Road Traffic Act;

A. On August 13, 2013, the Defendant: (a) around 07:30 on August 13, 2013, at the 14km section of Eunpyeong-gu Seoul Metropolitan Government from the ground parking lot to around 14:30 on the same day, without a driver’s license;

A stolen vehicle, such as described in the paragraph, was driven.

B. On August 13, 2013, around 19:30 on August 13, 2013, the Defendant, without a car driver’s license, at a about 5km section from the front road of Eunpyeong-gu Seoul Metropolitan Government to the front road area of the Eunpyeong-gu Seoul Metropolitan Government, Seodaemun-gu, Seoul, to the resident priority parking zone of the residents of the World Cup 371-1.
