1. The plaintiff's claim is dismissed.

Reasons
Basic Facts
On October 21, 2004, the Plaintiff entered into an insurance contract with the Defendant for non-dividendd general health insurance (hereinafter “instant insurance contract”) with the term of the contract from October 21, 2004 to October 21, 204, and the Defendant paid KRW 30,000,000 as diagnosis expenses in the event that the Plaintiff first becomes final and conclusive due to cerebrovascular diseases after more than one year from the date of the insurance contract.
The provisions relating to this case among the special terms and conditions for diagnosis of cerebrovascular diseases applicable to the insurance contract of this case are as follows.
Article 1 (Definition and Determination of Brain Diseases) ① Under this Special Terms and Conditions, the term “cerebrovascular diseases” means the diseases specified in attached Table 5 (See the table of classification of brain-related diseases) in the 4th Standard Korean History Classification.
(2) The diagnosis and confirmation of a brain-related disease shall be conducted by a person with a medical license (excluding dentists) of a hospital prescribed in Article 3 (2) of the Medical Service Act or a medical specialist of a medical institution recognized by the defendant as equivalent thereto, and the diagnosis shall be conducted based on the brain-related and negoological examination, computerized e-mail-e-mail e-mail e-mail e-mail e-mail e-mail e-mail e-mail e-mail e-mail e-mail e-mail (PEC), and e-mail e-mail e-mail e-mail e-mail e-mail.
