1. The plaintiff's defendant based on the insurance contract entered into between the plaintiff and the defendant.
Reasons
1. Basic facts
A. A. On November 2006, the Defendant entered into an insurance contract (hereinafter “instant insurance contract”) with the Plaintiff, but at the same time, the Defendant entered into the insurance contract (hereinafter “instant insurance contract”). In the event the insured events agreed upon to the Defendant during the insurance period, the Defendant would be compensated in accordance with the insurance contract. The content of the dual agreement on expenses for diagnosis of cerebrovascular diseases is as follows
1) Under this special terms and conditions, “the term “cerebrovascular disease” refers to the disease specified in [Attachment 11] [Attachment Table 1] (Classification Table of Brain Diseases) (Article 1(1)2) of the Medical Service Act or a person with a medical license (excluding dentists) of a hospital as defined in Article 3(2) of the Medical Service Act or of a medical institution as deemed equivalent thereto. (Article 1(2)3) If the insured of this Special Terms and Conditions becomes final and conclusive for the first time during the insurance coverage period of this Special Terms and Conditions, the Company shall pay the following amounts to the beneficiary only once (Article 2(1)4) [Attachment 11] [Attachment 11] which is classified as brain-related diseases as specified in the Rules for Classification of Brain Diseases, the Company shall not be eligible for the fourth amended Korean Standard Disease Death Classification (Enforcement Date of Statistics Korea Notice No. 2002-1, January 1, 2003), whichever is less:
cerebrovascular disease classification number
1. Spande part thereof;
2. Brain;
3. Other blood transfusions from a noncommercial head.
4. Color;
5. Severe wind not specified by blood transfusion or in light of the color;
6. Scrapping and fluoring of bovine spongiform encephalopathy which does not cause any bovine spongiform encephalopathy;
7. Fluoral color and fluoral color of inter-cerebrovasculars which do not cause any bovine spongiformiform encephalopathy;
