A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Larceny;
A. On September 21, 2015, at around 20:00, the Defendant, at the D dormitory located in Chungcheongnam-gun Hongnam Hong-gun, stolen this by taking away the victim’s physical card (F) and one bank body card from the victim’s wall located in the west where the victim E entered the above room and was located in the west, for night work.
B. On September 21, 2015, the Defendant withdrawn KRW 1,400,000 in cash by inserting a stolen personal card in the cash withdrawal machine managed by the victim agricultural cooperatives organized at Eup/Myeon 100 in a 200-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-si, as seen above, in which the Defendant entered a stolen personal identification number.
C. On September 21, 2015, the Defendant released KRW 2,500,000 in cash by inserting the stolen personal identification card in the cash withdrawal machine that is managed by the victim under the name in 136 single bank, a red-Eup Ma, Hongsung-Eup Ma, 136.
On September 22, 2015, the Defendant released KRW 100,000 in cash by inserting the stolen personal card in the name of the National Bank under the name of E and inputting the password prior to identification in the cash withdrawal period, which is managed by the victim under 167 new banks due to the 07:02 red-Eup in the same military.
2. On September 21, 2015, the Defendant violated the Fraudulent and Specialized Credit Financial Business Act: (a) around 20:42, 2015, the Defendant presented the victim I’s e-mail card in the name of a national bank in the name of Hong-gun, Hong-gun, to K as if he/she was his/her employee, and received a delivery of 16,500,000,000 won at the market price.
Accordingly, the defendant used stolen debit cards and acquired the property by deceiving the victim.
3. On September 21, 2015, the Defendant used computers, etc.: (a) committed a theft in the name of the victim E in the agricultural cooperatives organized in the agricultural community located in 100 in the Eup-Myeon, if the Defendant was organized in the Dang-gun on September 21, 2015.
