피고인은 2011. 11. 29. 22:50경 서울 영등포구 B 가게 앞에서, 112신고를 받고 출동한 서울 영등포경찰서 C지구대 소속 경사 D, 경장 E에게 “야 이 씨발놈아. 내가 작년에 청송에서 나온 빵잽이인데 니들이 나 저번에 넘겼었지 씨발 내가 잘 때가 없으니까 오늘 니들이 재워줘야겠어”라며 욕을 하고, 귀가를 권유하는 경사 D의 가슴을 1회 밀치며 순찰 차량의 앞을 가로막는 등 약 25분에 걸쳐 경찰관의 질서유지에 관한 정당한 공무집행을 방해하였다.
