A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From May 2016 to June 2016, the Defendant run a construction business by using workers at the site of new housing construction work in Jeju-si.

1. The Defendant, as a result of the withdrawal of complaint in the name of C, was serving from June 3, 2016 to June 23, 2016 at the site of the said new housing construction project, and did not pay the total of KRW 17,905,000 to six retired workers, including KRW 3,040,00,000, and was charged to the Gwangju District Court on November 28, 2016 due to a violation of the Labor Standards Act (No. 55943) at the Office of the Gwangju District Prosecutors’ Office (No. 2016), and was tried to undergo a trial at a 560-day Seoul District Court. In order to be exempted from punishment, the Defendant forged the written withdrawal of complaint in the name of C and attempted to submit it to the court.

A. On June 2017, the Defendant forged a private document: (a) was submitted by C while entering into a labor contract at the D office located in Jeju Warman.

C Copy of the resident registration certificate was reproduced.

Then, around June 10, 2017, the Defendant stated the Defendant’s U.S. F. F. F. F.C. in the name column, “C.” and “C.” in the name column of the date of preparation, on the written withdrawal of the complaint, which was reproduced for the purpose of exercising the right at the Defendant’s office located in Y.Y. E, and then affixed the Defendant’s U.S. seal on the name side of the name, and then copied as above.

C A copy of the resident registration certificate was attached to the withdrawal of the above complaint.

Accordingly, the Defendant forged a copy of the withdrawal of the complaint under the above C, which is a private document on rights and obligations.

B. The Defendant, in violation of the Resident Registration Act, was present at the trial date in the case of violation of the Labor Standards Act No. 2017 and No. 560 of the above court at around 09:40 on June 14, 2017 at the Gwangju-dong District Court No. 104 on the same day, and was present at the trial date in the case of violation of the Labor Standards Act No. 560 of the above court at around 2017, and a copy of the withdrawal of the complaint under the name of counterfeit C and the resident registration certificate attached thereto.
