Reasons
Punishment of the crime
Defendant
A is the director of the D Corporation (Seoul Northern-gu E and Gwangju Dong-gu F) to be in charge of the affairs of the construction site, and the defendant B works as the head of the facility project site at the same construction site.
The Defendants prepared a false statement of payment of labor cost in the name of G, H, and I who did not have worked at the above construction site, and conspired the victims to claim the payment of labor cost on the basis of this.
On June 2016, the Defendants submitted a false statement of payment of labor cost to the employees in charge of the victim company at the construction site of the instant E, claiming for the amount of labor cost to be reduced by KRW 100,000 per day from May 26, 2016 to May 31, 2016 at the construction site of E from May 26, 2016.
In fact, G did not have worked at the construction site of the above E.
The Defendants conspired to induce employees in charge as above and received KRW 596,70 on June 25, 2016 from the victimized person for the benefit of KRW 596,70,00, from that time. From that time to March 27, 2017, the Defendants received total of KRW 40,501,310 for the benefit of the victimized person on a total of 16 occasions, and had the victimized person pay KRW 618,690 under the pretext of employment insurance premium, etc.
