The prosecution of this case is dismissed.

1. The Defendant: (a) around 15:20 on July 16, 2013, in the facts charged in the instant case, the victim E (the victim E (the age of 63) who was the reporter of the Dail in the course of slaughter of a dog was taken without permission for coverage; (b) the Defendant, at the Defendant’s hand, who was slaughtered in the instant case, committed assault by twice the victim’s upper chest part, and twice the shoulder part, with the Defendant’s hand, who was slaughtered in the instant case.

2. Determination of the above facts charged cannot be prosecuted against the victim’s express intent pursuant to Article 260(3) and (1) of the Criminal Act. On November 14, 2013, after the institution of the instant indictment, the victim expressed his/her wish not to punish the Defendant. Thus, the instant prosecution is dismissed pursuant to Article 327 subparag. 6 of the Criminal Procedure Act.
