A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. On April 5, 2015, the Defendant, at the home of the Defendant’s female-friendly job offers (here, 16 years of age; hereinafter the same shall apply) located in Kim Jong-si, 2015, she: (a) taken the Defendant’s female-friendly job offers (here, 16 years of age; hereinafter the same shall apply) into the victim’s room, she took off the victim’s clothes that he/she refuses to refuse to do so, and (b) took off the victim’s body and resistance, she continued to keep the victim’s body and resist, and (c) took twice the victim’s resistance, and led him/her to sexual intercourse once, which led him/her to rape.
