피고인은 2015. 2. 28. 17:00 광주 남구 D, 103동 1606호 피고인의 집 거실에서 갑자기 피해자 E(여, 51세)의 뒤쪽에서 그녀를 안고 컴퓨터 책상 반대편으로 끌고 가 바닥에 눕힌 다음 옷을 벗기고, 이에 피해자가 소리를 치고 발버둥을 치면서 완강히 거부하는데도, 그녀의 몸 위에 올라 타 손과 무릎으로 팔을 짓눌러 움직이지 못하게 하여 반항을 억압한 후 피해자에게 키스를 하고 젖가슴을 만지고 입으로 빨고 음부를 만지면서 계속하여 반항하는 피해자에게 “가만히 있어.”, “끝날 때까지 집에 보내지 않겠다.”고 윽박지르고, 피해자가 심하게 몸부림치다 지쳐 자포자기하게 되자, 그녀의 음부에 성기를 삽입하여 1회 간음하여 피해자를 강간하였다.
