1. The Defendant: (a) KRW 293,986,633; and (b) annually from May 1, 2014 to May 21, 2015 to the Plaintiff.

1. Facts of recognition;

A. The Plaintiff is a company that conducts online advertising agency business.

The Defendant is a company operating an “rotototong” in which an opportunity for lottery is provided with a lottery ticket.

B. 1) The Plaintiff entered into a mobile platform development agreement with the Defendant on September 1, 2013 (hereinafter “instant development agreement”).

(2) At the time of the conclusion of the instant development agreement, the term “Ondol mobile platform development agreement (Evidence A No. 1)” prepared by the instant development agreement includes the following:

(1) On the basis of the provision of the language system that the Defendant intends to provide to a smartphone-based download and ahphone (hereinafter referred to as the “instant platform”) refers to the establishment and development of an application program on the romoto website and the mobile web site, and on the romoto website and the mobile web site.

(2) The Plaintiff develops and supplies “romoto mobile platform” in accordance with the following development standards set by the Defendant:

The details of supply for the construction of a service are as shown in attached Table 1.

(3) Total amount of development: 142 million won (excluding value-added tax) shall be deposited in cash with the Plaintiff’s designated account within seven days from the date of issuance of the tax invoice, and the Defendant shall deposit in cash the part payment of KRW 30 million (excluding value-added tax) within 30 days from the date of conclusion of the contract.

Any balance shall be deposited in cash to the Plaintiff’s designated account on February 28, 2014 when the repair period expires.

3) The Plaintiff and the Defendant agreed to increase the contract price of KRW 2 million due to the problem of tax return, etc., and the final agreed contract price is KRW 158.4 million (the amount under the contract).
