A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
On April 14, 2011, the Defendant was sentenced to three years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) in the Cheongju District Court's Jeju District Court's Jeju District Court's Jeju District Court's branch on February 26, 2014.
1. The crime committed on September 18, 2014;
A. On September 18, 2014, around 23:50 on September 18, 2014, the Defendant: (a) ordered “E” restaurant where the victim D (ma, 23 years of age) located in the Dong-gu Busan Metropolitan City (E) to take an order of an amount equivalent to KRW 11,200,00, such as murdering and so on, which did not have money during the water; and (b) demanded food costs to the victim who demanded food to take lives (e.g., lives). Around 23:50, the Defendant: (a) threatened the victim by threateninging the victim by paying lives (i.e., lives) to the victim who demanded food payments; and (c) obtained pecuniary benefits equivalent to the said amount by having the victim waive his claim for food payments.
B. The Defendant interfered with the business of the victim at the above time, place, and the victim D, as above, and obstructed the victim’s restaurant business by force by continuously engaging in a large amount of 30 minutes of talking.
2. The crime on September 19, 2014;
A. On September 19, 2014, the Defendant: (a) around 20:00, at the beauty art room of the victim G (Nam, 43 years of age) located in the Busan East-gu, Busan-gu; (b) had the victim engage in the strike despite having no money in water; and (c) threatened the victim with the victim by demanding the victim to pay the 50,000 won of the strike cost by “the victim was released from the Ghana prison”; and (d) by having the victim waive the claim for the expenses of the strike, the Defendant acquired pecuniary benefits equivalent to the above amount by having the victim who was drinking, waive the claim for the expenses of the strike.
B. The Defendant, in the foregoing date, place, and the above victim G, shall make the above victim G a threatening speech, and shall continue to engage in the victim’s beauty room business by force by taking a large amount of speech for about 30 minutes.
