F On April 12, 2011, the Busan District Court sentenced two years of imprisonment with labor for a violation of the Game Industry Promotion Act at the Busan District Court, and was sentenced to one year of imprisonment with labor for a violation of the Act on Special Cases concerning the Regulation and Punishment of Speculative Acts, Etc. at the Busan District Court on September 14, 2012 and completed the execution of the said sentence on April 11, 2014.
1. On March 17, 2015, Defendant A, D, and F’s joint criminal conduct: (a) installed 44 game instruments in the game site of “Sado” and “Satong-do” on the first floor of J 1st (J) Busan-dong-gu, Busan-dong-gu, in charge of the employment of employees, settlement of profits, and overall management of night-time game markets; (b) Defendant F is responsible for attracting and managing customers in the game room while working for the head of office; and (c) Defendant D was recruited to exchange in cash with the cards with points obtained by customers.
From March 17, 2015 to March 25, 2015, the Defendants: (a) had many unspecified customers who find out in the said game place input cash in the said game machine; (b) had them use the said game machine; and (c) had them exchange the points they acquired in the said game machine after deducting 10% of the fee from Defendant D through the money changers outside the said game place.
Accordingly, the above Defendants conspired to exchange the results obtained through the use of game products for business purposes.
2. Abetting and abetting Defendant B, C, or E
A. Defendant B and C work as an employee on condition of receiving KRW 80,000 per day from March 17, 2015 to March 25, 2015 in the above game room. Defendant B and C, knowing that the above game room is a speculative game room for exchanging customers, as described in paragraph (1), verified the scores of an unspecified number of customers in the game room, and granted money to exchange customers’ scores.
