피고인은 2012. 12. 12. 07:15경 부천시 원미구 B지구대에서, 공소외 C등 불상의 사람들이 있는 자리에서 경찰관인 피해자 D(33세남)에게 “이런 씨발 좆만한 새끼야, 죽여버린다. 씨발 짭새 개새끼야, 뒈지고 싶냐”라고 큰소리로 욕설을 하여 공연히 피해자를 모욕하였다.
