피고인은 2012. 4. 6. 04:00경 대구 서구 B지구대에서 위 지구대 소속 경찰관인 피해자 C가 자신을 무전취식으로 즉결심판에 회부하려 한다는 이유로 화가 나 경찰관 여러 명이 있는 가운데 피해자에게 “야 십새끼야, 주인 불러와, 좆만한 새끼들이 소장 불러와, 소장 어딨노, 세상이 어떤 세상인데 이 씨발놈들아, 개새끼들 소장 어디 갔어 오라해, 이 시간에 근무 안서고 빠구리 하러 갔나, 이새끼들 업주하고 친한 사이가, 돈 받고 사건하나, 야 이 십새끼들아”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
