Reasons
Punishment of the crime
1. On March 24, 2011, the Defendant, along with B, had the insurance company receive the insurance money by receiving the accident from the insurance company as if the traffic accident occurred. On March 24, 2011, around 13:00, the Defendant received a false accident with the purport that, although there was no traffic accident by a car owned by the Defendant, the Defendant called the victim Samsung F&M520 Marine Insurers Co., Ltd. to the person in charge of the above vehicle’s insurance company, and the Defendant had had contacted B with the crosswalkd while driving SM520 car, and he received a false accident with the purport that the Defendant had contacted B with the crosswalkd the above vehicle while driving the said vehicle, and he received KRW 98,00 from the victim on April 5, 2011, and had the victim receive KRW 998,000 from the post office account in Yeongdeungpo-gu under the pretext of agreement, and had the victim receive KRW 1,948,730 on July 1, 2011.
2. On August 1, 2013, the Defendant, a co-principal with G, was involved in an accident involving the lower right-hand wheels of the said car while driving a H M&L car on the front side of the G-dong, Yangcheon-gu, Seoul, Yangcheon-gu, Seoul.
Although the Defendant was unable to receive insurance money in the case of an accident caused by the Defendant’s driving, he was insured only when G was driven by the owner, who is the owner of the vehicle, but the Defendant conspired to receive insurance money by filing a false accident report as if G was driven by the front right, while G was driving.
Accordingly, on August 1, 2013, G filed a false accident report with the purport that two of the victims ELI, an insurance company that is a member company of the above marina vehicle, met with the news bublue while being driven by G by telephone to the person in charge of the above marina vehicle insurance company, and two of them met with the news bublue while being driven by G, and its members are 1,163,400 won as the unrepair cost from the victim company to the bank account of G on August 2, 2013.
