1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Basic Facts

On May 12, 2017, the Defendant publicly announced the “Plan for Selection of Operators of Outdoor Sports Facilities within the Development Restriction Zone in the Southern-si, Yangyang-si (Public Notice No. 2017-744, hereinafter “instant public announcement”) and the main contents thereof are as follows:

1. Summary;

(a) Kind of facilities: 2 kinds of facilities in the vicinity of Jin-Eup, Geumdong, Geumdong, Geumdong-dong, Gyeongdong-dong, Simdong-dong, and Myeon-dong 1 (2 area) in two zones based on the area size of 1 (1,2, and 3 area in the area of the outdoor sports facilities located in the area of the outdoor sports facilities located in accordance with subparagraph 5 (h) of Article 13 [Attachment Table 1] of the Enforcement Decree of the Act on Special Measures for Designation and Management of Development Restriction Zones;

(b) Allocation quota: Two branches of outdoor sports facilities (excluding paragraph (2));

3. Receipt of applications;

A. The period of public notice: May 12, 2017 to June 11, 2017

Period of receipt: June 12, 2017 (09:0) to June 14, 2017 (18:00) (3 days) (3 days)

(c) Place of receipt: Inter-sea viewing construction and (non-section 4);

(d) Receiving method: Visiting (not receiving by mail, facsimile, or door-to-door delivery);

(e) Documents to be submitted: Applications and required documents (Reference to Form 1);

4. Method and notice of selection;

(a) A person who intends to install outdoor sports facilities within a development-restricted zone shall receive an application form and the Gu non-documents from the male and the male viewing division within a period of receipt (b).

(c) To examine whether the qualification standards for application are met for the selection of business operators and give differential points pursuant to the standards set forth in attached Table 1, and to notify individual business operators after decision;

5. Cautions;

(a) The applicant shall be bound to take full account of the relevant laws and regulations as well as the requirements for the application of the business operator, submit documents, and shall be bound to ensure that the applicant is not at a disadvantage due to unfolding and unverification.

The submitted documents shall not be returned in all, and shall not be perused and submitted for additional documents after receipt.

On June 14, 2017, the plaintiff is against the defendant who is currently in use as a field of camping in the Nam-dong 208-1, Namyang-dong.
