A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 19, 2017, the Defendant embezzled the lost resident registration certificates of the victim C around the Mayang-gu B in Ansan-gu, Ansan-si, and did not take procedures to return them to the victim and embezzled them for the purpose of his use.

2. Around March 10, 2017, the Defendant received medical treatment by deceiving an employee in charge of the E Hospital’s name and resident registration number, who was the subscriber of the National Health Insurance Co., Ltd., as if he/she were C, and had the above hospital, who was unaware of such fact, file an application for medical care benefits expenses with the Health Insurance Review and Assessment Service, and had the victim notified of such fact receive KRW 9,110 from the National Health Insurance Service to March 19, 2020 the sum of KRW 1,495,80 in the same way as indicated in the list of crimes in the attached Table from around 159 to around March 19, 202, thereby having each hospital and pharmacy receive medical care benefits from the same amount of money.

3. No person who violates the National Health Insurance Act shall receive or allow another person to receive insurance benefits by fraud or other improper means;

On March 10, 2017, the Defendant received insurance benefits, such as medical treatment, etc. equivalent to the sum of KRW 1,495,800, from each hospital and pharmacy by unlawful means over 159 times from around the time of receiving insurance benefits by misappropriation of C’s personal information at the E Hospital located in Suwon-gu, Suwon-si, and received medical examination and treatment from that time to March 19, 2020.

4. No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number.

On March 10, 2017, the Defendant, at the E Hospital located in Suwon-si, Suwon-si, requested the identification of himself as C, at the above hospital staff in charge of the above hospital’s resident registration number.
