A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. When the defrauded was unable to receive insurance benefits from the National Health Insurance Corporation due to delinquency in the payment of national health insurance premiums, the defrauded used personal information, such as the resident registration number C, which was known to the general public, to use the hospital, pharmacy, etc., and had the said Corporation receive insurance benefits by means of making payments to the hospital and pharmacy.

On January 4, 2010, the Defendant, at the E-won located on the second floor of the D Building in Yangju-si, was treated as “the main blood pressure” with the resident registration number of C as one of C, and had the above hospital-related person file a claim for KRW 7,724, excluding the principal charges, with the victim’s interest.

The Defendant, by deceiving the victim as above, had the victim pay KRW 7,724 to the above hospital the amount of 7,724 to obtain pecuniary benefits equivalent to the said amount.

The Defendant, including that, from January 4, 2010 to August 31, 2015, had the victim pay a total of KRW 1,862,124 by the same method 74 times, such as the list of crimes in the attached list of crimes, and acquired pecuniary benefits equivalent to the above amount.

2. No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number.

Nevertheless, around October 26, 2010, the defendant used the other person's resident registration number by receiving the C's resident registration number as if he was C, from the E's second floor of the D Building in Yangju-si.

The Defendant, including this, unlawfully used another person’s resident registration number 49 times in total, from October 26, 2010 to August 31, 2015, as shown in the crime sight table (No. 26 to 74).
