1. Basic facts

A. The status of the parties concerned ordered the electrical construction of regional center facilities (hereinafter “instant construction”). In order to carry out the instant construction, Defendant Seocho Electric Power Development Co., Ltd. (hereinafter “Defendant Western Electric Power”) and Defendant Taedong Electric Power Co., Ltd. (hereinafter “Defendant Seodong Electric Power”) constituted a joint supply and demand organization (hereinafter “instant joint supply and demand organization”), and Defendant Seodong Electric Power Co., Ltd. issued a contract guarantee for the execution of the instant construction.
