Reasons
Punishment of the crime
[2015 Highest 2234]
1. The joint criminal conduct of Defendant A and E;
A. At around 03:18 on June 18, 2015, the Defendant, along with E, found a ludice apartment underground parking lot located in the Gangdong-gu Seoul Olympic Games, found a private taxi owned by the victim F, and reported the network E, and the Defendant was not able to find money and valuables by cutting off the gold machine so far as possible after cutting between the date-type draber and the back glass window of the taxi in his possession, and by putting the hand into the lock, and cutting off the lock machine, but did not find any money and valuables.
Accordingly, the defendant attempted to steals property in collaboration with E, but did not commit an attempted crime.
B. On June 18, 2015, between 04:00 and 05:00, the Defendant discovered H private taxi at the 25-ro 3-dong underground parking lots in Gangdong-gu, Gangdong-gu, Seoul, and reported the network to E, and the Defendant: (a) destroyed milch glass by cutting between the date type dricker who was in possession and then destroyed the milch glass; and (b) laid down the locking device into the locking device and carried it out to the victim’s cash amounting to 50,000 won.
