A defendant shall be punished by imprisonment for three years.
The victim shall be the five keys (Nos. 2, 3, 4, 6, and 7) of seized exc. c. (No. 21).
Reasons
Punishment of the crime
[criminal records] On June 5, 2008, the Defendant was sentenced to three years of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Central District Court, on June 8, 2012, and two years of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Northern District Court, and on May 1, 2015, the Defendant was sentenced to two years of imprisonment with prison labor for habitual larceny at the Seoul Northern District Court and completed the execution of the sentence on March 11, 2017.
[Criminal facts]
1. On September 20, 2017, the Defendant stated this part of the victim C, Inc., E, a corporation, which is obviously a clerical error in C, and thus ex officio correction is made because it is obvious that it is a clerical error in C.
In addition to holding two keyss to the storage box of goods, five keyss to the storage box of goods (Evidence No. 21) have been attached between around that time to September 22, 2017, at the same place as the list of crimes Nos. 1 to 3 times.
2. On September 24, 2017, the Defendant: (a) by releasing the storage of the aforementioned letter or goods from “sable keys” made by using five of the keyss kept in front of the aforementioned letter or goods; (b) the Defendant left 400,000 won in cash owned by the victim F while in custody of the said letter or goods; (c) from around that time until around October 23, 2017 to around October 19:40, the Defendant stated the sum of KRW 2,830,000 in total at the market price of seven times in total at the same place, such as [Attachment] Nos. 4 through 8,10,110, and 2,830,000 in total at the same time as the list of crimes, but this is obvious that this is a 2,850,000 won in error ex officio.
There is a considerable amount of money and attempt to steals cash in the same way at the same place as the 9th period of the annexed crime list, but it is the only key.
