A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Although the Defendant had suffered excessive debt B due to the business failure of C in a de facto marital relationship, C's family members were forced to receive the money by threatening C's son and B's victim D (the age of 32) who is a deadly disabled person in a de facto marital relationship.
1. On May 16, 2014, around 01:28, the Defendant sent a voice message with the content that “On May 16, 2014, the Defendant sent the victim’s cell phone from the Defendant’s house located in Gangseo-gu Seoul Metropolitan Government E and 403 dong 109, to the victim’s cell phone, and threatened the victim’s body by sending a voice message with the content that “on May 16, 2014, the Defendant gets off all commercial stores in the East-gu, Seoul Metropolitan Government Ma and 403 dong 109, with the victim’s cell phone.”
2. Around May 16, 2014, the Defendant, at around 02:29, posted a phone call from the victim’s cell phone on May 16, 2014 to the victim’s cell phone, and threatened the victim’s and his family members with the victim’s cell phone in the above Defendant’s house as follows: (a) “The Defendant she saw to flick, flick, flick, flick, flick, and flick; (b) The Defendant flicked the victim’s body.”
3. On May 16, 2014, around 02:34, the Defendant, at around May 16, 2014, posted a victim’s cell phone with the victim’s cell phone at the above Defendant’s home, and threatened the victim’s and the victim’s family members with physical harm.
4. On May 27, 2014, around 22:37, the Defendant committed the crime: (a) around 22:37, May 27, 2014; (b) around 10 years from the victim’s cell phone to the victim’s cell phone; (c) on the part of the Defendant’s house, the Defendant would have resolved if he became aware of the settlement within 5 years; (d) ten (10) the son was dead; (e) Dora, the son would have knife a person who is son of the son.
