Defendant shall be punished by a fine of KRW 2,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection shall distribute information with a content that arouses fear or apprehensions to reach other persons repeatedly through an information and communications network;

Nevertheless, at around 23:41 on July 19, 2012, the Defendant sent a text message to the victim on the ground that C, the victim, was not paid the money borrowed from him/her, and then sent a text message that “the victim must do so in Korean medicine with limited limits.” From around that time to October 3, 2012, the Defendant sent a text message that arouses fears or apprehensions for the victim 17 times, such as written in the list of crimes in the annexed sheet.

2. 협박 피고인은 2013. 1. 7. 00:50경 장소불상지에서 위 피해자의 휴대전화로 전화를 걸어 “야 C이 너 씨발년, 내가 너 오늘 절도로 고소했는데 그냥 안 놔둬, 이 씨브랄년아 이 좆같은 년아, 너는 내가 죽여버릴 거니까 너 내가 죽이고 내가 이 씨발년아 그냥 자살해서 죽을 거니까 알아서 해 너 조만간 대질신문할 때 보자 나한테, 너, 내가 경찰서에서 너 죽여버리고 나는 자살할 거니까 그런 줄 알아”라는 내용의 음성메시지를 남기고, 2013. 4. 18. 21:37경 같은 방법으로 피해자의 휴대폰에 “야, C이! 기다려보면 아는데, 너, 내가 죽일건데, 조금만 기다리고 있고 내가 죽은 네가 죽든 누구 하나는 죽어야지 끝난다, 이 씨발년아, 내가 너 죽이는 일에 전념을 할 테니까 조금만 기다려라 기다려라 어떤 일이 벌어지나 ”라는 내용의 음성메세지를 남겨 피해자에게 어떠한 위해를 가할 것과 같은 태도를 보임으로써 피해자를 협박하였다.
