Punishment of the crime
"2013 Highest 1104"
1. Around September 3, 2013, the fraud Defendant issued a false statement to the effect that “The victim who lives on the upper house was laid off,” and the convenience store E was found to have been posted to the victim’s “C convenience store” located in Ischeon-si, Gyeonggi-do, with the victim’s goods purchased at the victim’s “C convenience store”, and left the said convenience store, and entered the convenience store E., and caused the victim’s heart.”
However, in fact, the defendant did not have received the victim's request from the victim to find the wall, but did not have any intention or ability to deliver the wall to the victim.
The Defendant, as such, received cash 200,000 won, one resident registration certificate, and one copy of the market price with two credit cards, which are owned by the victim, who was under his custody by deceiving E and acquiring it from E.
2. At around 03:00 on September 24, 2013, the Defendant acquired one copy of the modern credit card owned by the victim F, which is the victim’s loss, from the cross-sckive stairs located in the Changcheon-si, Leecheon-si, Gyeonggi-do., one copy of the No. 1, No. 3, and one copy of the resident registration certificate.
The Defendant, as such, did not take necessary procedures such as returning the above damaged goods that he acquired, and embezzled the property that he left the possession of the victim.
3. From September 24, 2013, around 03:30 on September 24, 2013, the Defendant: (a) purchased meat in “H” operated by the victims’ names in Leecheon-si G located in Gyeonggi-do; (b) presented the No.F card acquired and kept in custody as stated in paragraph (2) to an employee under his/her name as if he/she had the right to use; and (c) exempted the payment of KRW 12,300 of the price by signing sales slips; and (d) obtained pecuniary benefits equivalent to the same amount.
