The defendant shall be innocent.

1. On December 17, 2014, the Defendant obtained a license for livestock product processing business (food processing business) around December 17, 2014, and “D” on the Nam-gu Incheon Metropolitan City C and the first floor is operating a livestock product processing business entity with monthly sales of KRW 70 million.

However, around March 15, 2016, the Defendant received 65 km (unit price of KRW 1,040,000) from Korea Food Co., Ltd. Korea Food Co., Ltd. for the purpose of selling livestock products without indicating the date of manufacture, expiration date of distribution, etc. and stored them in the cooling for sale.

2. Article 6(1) of the Act on the Sanitary Control of Livestock Products provides that "the Minister of Food and Drug Safety may determine and publicly notify the standards for labeling of livestock products for sale. In such cases, the Minister of Food and Drug Safety may separately determine the standards for labeling of livestock products pursuant to Article 2 subparagraph 1-2 of the Livestock Industry Act." Article 6(2) provides that "livestock products, the standards for labeling of which are determined pursuant to paragraph (1), shall be indicated. The same shall also apply to livestock products imported for sale." Article 6(3) provides that "no livestock products, the standards for labeling of which are determined pursuant to paragraph (1), shall be sold, or processed, packaged, stored, transported, or displayed for sale, unless they are indicated pursuant to

Accordingly, it is examined whether the "saunch" of this case, which was sold at the time or kept without the purpose of sale, constitutes a case where the "saunch" should be indicated in accordance with the standards. However, the subject of labeling under Article 3 of the "saunch" under the Ministry of Food and Drug Safety, is subject to labeling

2. Imported livestock products, other than those referred to in subparagraph 1, contained in a misunderstanding or package;
