Defendants shall be punished by imprisonment for one year.

However, for three years from the date this judgment becomes final and conclusive against Defendant A.

Punishment of the crime

Defendants and E are those operating gas stations in the trade name of “G” with five oil storage facilities (three transit, one smoke, one oil without delay), 18 alcoholic beverage, etc. from around December 8, 2014, and 1/3 ratio of shares of each of them, and H and I are employees of the above gas station.

1. He/she shall not install or remodel business facilities for the purpose of manufacturing, importing, storing, transporting, keeping, or selling fake petroleum products through a single crime committed by Defendant B;

Nevertheless, on December 2, 2014, the Defendant: (a) installed a chilling wall of about 2.9 meters in length at the entrance of the storage facility for transit so that it can not collect samples of fake petroleum stored by a controlling institution, etc. at the above oil station; and (b) stored the light oil within the facility.

As a result, the Defendant remodeled business facilities to store and sell fake petroleum products.

2. No one who commits a joint crime against the Defendants shall manufacture, import, store, transport, keep, or sell fake petroleum products;

Nevertheless, Defendants and E had the mind to sell and store fake petroleum at the above gas station, around December 25, 2014, sold 1,355 won per liter petroleum (mix of light oil and leap base oil, etc.) to customers in the above gas station (mix of 6:4) and sold approximately 68,683,580 square meters in total to customers from January 7, 2015 from that time until January 7, 2015. Around January 8, 2015, Defendants and E sold approximately 51,700 liter of the above fake petroleum sales proceeds to customers. Around January 8, 2015, the above gas station kept approximately 8,300 liter of the above fake petroleum for sale at the oil storage facility No. 2 of the gas station.

Accordingly, the Defendants sold and stored fake petroleum products in collusion with E.
