Defendant shall be punished by a fine of KRW 1,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

On July 17, 2013, the Defendant was sentenced to ten months of imprisonment for fraud at the Busan District Court, and the judgment became final and conclusive on October 5, 2013.

1. The defendant who forged a private document shall aim to open the mobile phone in spite of the absence of consent or delegation from B:

A. Around December 6, 2011, at the mobile phone agency of D located in Busan Seo-gu, Busan Seo-gu, a new service contract in the name and resident registration number of B, using the name and resident registration number of B to open E mobile phone and forged the service contract in the name of B, a private document on rights and obligations.

B. Around December 20, 2011, at the same place, the F mobile phone was opened in the foregoing manner, and the F mobile phone was forged by preparing a new service contract in the name of B, a private document on rights and obligations.

C. Around December 22, 2011, at the above place, G mobile phone was opened through the aforementioned method, and a new service contract in the name of B, a private document on rights and obligations, was prepared and forged.

2. The Defendant, at each time and at each place specified in the above paragraph (1), submitted a new service contract in the name of B, which was written in the above manner, to a mobile phone agency employee who knew of the forged fact.

3. Fraud;

(a) At the date of paragraph 1(a) and at the same time, the fact to the staff in charge of the victim D, even if the victim D opened a mobile phone in the name of B, was unable to pay the cost, the said staff opened the mobile phone and took property benefits equivalent to KRW 2,581,170 from the victim D, even though he/she did not have any intent or ability to pay the cost.

B. On December 29, 2011, the fact at the I's mobile phone agency located in the Busan-gu Busan-gu Busan-si is a mobile phone (J) equivalent to 89,800 won at the market price under the name of the victim B as if it were to pay all of the cost, even if it was received from the victim B even though it was not possible to pay the cost of the mobile phone.
