피고인은 2013. 5. 16. 02:30경 부산 사하구 B에 있는 상호가 없는 피해자 C(52세)이 운영하는 포장마차에서, 술에 취한 채 술을 주문하여 마시던 중 화장실에 가려고 할 때 피해자가 “부축해 드릴까요.”라고 하자 기분 나쁘다는 이유로 손으로 탁자를 치고 발로 의자를 차고, 가게 앞 닭튀김용 기름통을 발로 차 기름이 바닥에 흘러 보행자들을 불편하게 하는 등 약 40분 동안 행패를 부리는 등 위력으로써 피해자의 포장마차 영업 업무를 방해하였다.
