The crimes provided for in Articles 2 and 3(a) of the judgment of the defendant shall be punished by imprisonment with prison labor for not more than two months and Articles 1, 3(b) and 4 of the judgment.

Punishment of the crime

On August 19, 2013, the Defendant was sentenced to a suspended sentence of one-year imprisonment for a crime of fraud at the Ulsan District Court, which became final and conclusive on August 27, 2013.

1. The Defendant, around August 30, 2013, posted a false statement on the “C (I, 35 years old, by remitting the price to a national bank account, I would like to send a team bridge by remitting it to the national bank account.” The Defendant, on the Internet, posted a false statement on the “I, I will sell the team bridge.”

However, since the defendant did not have a team bridge, even if he received money from the victim, he did not have the intention or ability to send the team bridge to the victim.

The Defendant received KRW 75,00 from the victim’s national bank account (D, IM) in the name of the Defendant on the same day, and received KRW 75,000 from around that day to November 13, 2013 in total five times in the same manner as shown in attached Table 1.

Accordingly, the defendant was informed of the victims and received each property.

2. On May 27, 2013, the Defendant: “I sell 1.30,00 won contact diskettes of the EE Republic of Korea” on the Internet NAVVER’s online page at a non-place on May 27, 2013; “I will send a ticket if I send the first sale proceeds, I will send the ticket”; and “I will send the ticket. I will send the first sale proceeds. I will send the ticket in the name of the Defendant to the bank account (G).” The Defendant received KRW 50,000,000, which is part of the price.

However, as the Defendant did not have a contact pocket, the Defendant did not have any intention or ability to send a ticket even if he received the sales proceeds from the victim.

Ultimately, the Defendant was transferred 50,000 won by deceiving the victim.
