피고인은 2013. 9. 17. 20:30경부터 같은 날 21:10경까지 경남 고성군 C에 있는 D 앞 길에서 E, F이 1회에 각각 15만 원을 걸고 이기는 사람이 판돈 30만 원을 가지는 방식으로 윷과 윷판을 사용하여 윷놀이를 가장한 도박을 한다는 사실을 알면서도 이를 돕기 위하여 그 장소에서 윷놀이의 윷말을 서주어 이를 방조하였다.
