피고인은 2018. 5. 3. 16:00 경 천안시 서 북구 C에 있는 D 소유인 E 빌딩 주차장에서, 중고로 매수한 F 벤츠 E250 승용차에 잔고장이 많이 난다는 이유로 화가 나, 위 빌딩은 4 층으로 지하 1 층에는 노래방, 지상 1 층 및 2 층에는 주점, 지상 3 층에는 마사지업소, 지상 4 층에는 스크린 야구장이 입 점해 있고 주차장 내부 공간이 협소하여 위 승용차에 불을 붙이면 위 빌딩에 불이 옮겨 붙을 수 있을지도 모른다는 것을 인식하면서도 위 승용차의 좌석 및 트렁크에 휘발유를 뿌린 후, 가지고 있던 라이터를 이용하여 불을 붙인 의류를 위 승용차 안에 놓아 위 승용차의 내부에 불을 붙였다가 스스로 소화기를 이용하여 그 불을 껐다.
