Defendants shall be punished by a fine of KRW 1,500,000.

In the event that the Defendants did not pay the above fine, each of them is 100.

Punishment of the crime

No one shall make, or have another person make contributions to, an election for a candidate or a political party to which he/she belongs, or may provide money, valuables, entertainment, or other property benefits to an elector in the competition for the purpose of having another elector cast his/her vote for a competition.

Nevertheless, on March 28, 2017, the Defendants, who are the candidates for Pyeongtaek D and E, agreed to prepare buses and urban communities in order to allow their residents to participate in the 19th presidential election campaign at the 19th presidential candidate competition (hereinafter referred to as “ordinary election”), which is held on March 28, 2017, in Busan Gangseo-gu Busan, where they reside, and Defendant B promised to participate in bus and urban communities by telephone to G bus drivers at around March 24, 2017, and Defendant A paid bus service charges and urban revitalization charges.

On March 28, 2017, from around 10:00 to around 11:00 of the same day, the Defendants had G operate 14 J Bus, which was prepared in advance in Busan Gangseo-gu F and I, with 14 residents, including K, to the Busan Northern L Center, which is the place of light-line voting, and 12 persons including K, other than M and N, who were unable to participate in the light-line voting due to lack of identification card among 14 residents, participated in the light-line voting and cast a vote.

At around 12:00 on the same day, the Defendants continued to put 14 residents, including K, in the above L community service center, in the above L community service, and continuously provided 8 residents, including K, with one urban village prepared in advance.

As a result, the Defendants conspired to make a contribution by providing transportation convenience equivalent to KRW 300,00 for D candidates or E parties in relation to the 19th presidential election, and the total amount of KRW 363,200,00 for eight urban districts equivalent to KRW 63,200, and provided property benefits equivalent to the same amount for the purpose of enabling 12 electors to vote.
