A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. On May 21, 2018, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Use and photographing of Cameras, etc.) accessed the victim’s body on May 21, 2018, in multi-household B located in Ansan-gu, Ansan-si, the lower court: (a) accessed the structure where the victim resides by entering the main body of the above building, and immediately approaching the window; and (b) taken the body of the female victim in the name of the shower in the toilet by using the camera function of the Defendant’s LG smartphonephone in an open cretion of windows; and (c) taken the victim’s body against the victim’s will that may cause sexual humiliation or humiliation, such as the list of crimes in attached Table 1, for 23 times from around that time to September 27, 2019.

On June 2, 2018, the Defendant taken pictures against his will the body of the victims who could cause sexual humiliation or shame on nine occasions, as described in the list of crimes in attached Table 2, from that time until September 11, 2019, at the residence of the Defendant in Ansan-si, Ansan-si, an Ansan-si, the Sinsan-si, the Defendant: (a) had sexual intercourse with the female victims; and (b) had taken pictures of the body of the said victims who were able to cause sexual humiliation or humiliation on nine occasions, using the Defendant’s LG smartphone function; and (c) had sexual intercourse with the female victims.
