A defendant shall be punished by imprisonment for one year.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

On September 4, 2015, the Defendant was sentenced to a fine of one million won for a violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (use and photographing of cameras, etc.) at the Seoul Central District Court on September 4, 2015, and on September 2, 2016, the Defendant was sentenced to a suspended sentence of two years for imprisonment for the same crime in the same court on September 2, 2016, and the said sentence became final and conclusive and is still under the suspended sentence.

피고인은 2017. 1. 20. 23:40 경 서울 강남구 C 건물 지하 1 층 D 화장실 앞에서 피해자 E( 가명, 여, 28세) 이 여성용 화장실에 들어가는 것을 발견하고 피해자의 용변 보는 모습을 촬영하기로 마음먹고 피해자를 따라 여성용 화장실에 들어가 D 매니저 F가 관리하는 건조물에 침입하고, 계속하여 피해자가 이용하는 용변 칸 옆 칸에 들어간 다음 용변 칸 칸막이 위로 피고인 소유의 갤 럭 시 A7 스마트 폰을 쥔 손을 뻗어 위 스마트 폰의 카메라 기능을 이용하여 변기에 앉아 용변을 보는 피해자의 모습을 동영상 촬영한 것을 비롯하여 2017. 1. 11. 경부터 2017. 1. 20. 경까지 별지 범죄 일람표 기재와 같이 총 6회에 걸쳐 변기 위에 앉아 용변을 보는 피해자들 6명의 모습을 동영상 촬영하였다.
