A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Since the Defendant is not a person handling narcotics, he/she shall not sell, deliver, or administer psychotropic drugs, psychotropic drugs, Mesophalopon (hereinafter referred to as "coponon").

1. 필로폰 매매 피고인은 2020. 8. 24. 20:00경부터 같은 날 21:00경 사이 같은 중국 동포 출신인 B로부터 위챗 메신저를 통해 필로폰을 매수하겠다는 연락을 받고, B로부터 피고인 명의 계좌로 1,700위안(약 30만 원)을 송금 받고, 피고인은 같은 중국 동포 출신인 C에게 위챗 메신저를 통해 연락하여 1,200위안(약 20만 원)을 C이 알려준 계좌로 송금하면서 필로폰을 구해달라고 부탁을 하였다.

이에 C은 서울 구로구 D에 있는 E 인근 번지 불상의 주택가에 있는 주차금지 표지판 밑에 비닐팩으로 포장한 필로폰 약 3그램을 숨겨 놓고 이를 사진 촬영하여 위챗으로 피고인에게 전송하였고, 피고인은 C으로부터 전송받은 사진을 B에게 전달하여 B가 2020. 8. 25. 00:00경 위 장소로 찾아가 필로폰 약 3그램을 가져가도록 하였다.

Accordingly, the defendant purchased and sold philophones.

2. Receipt of Handphones;

A. At around 20:00 on August 27, 2020, the Defendant received philophones without compensation from G in the street in the vicinity of the Fudio in Suwon-si, Suwon-si, by giving and receiving philophones without compensation.

B. On September 15, 2020, around 15:00, the Defendant: (a) found a cigarette fence in the street room adjacent to the area of Suwon-si, Suwon-si, which contains approximately two-minutes of philopon attached to C; (b) received a philopon free of charge.

3. On September 19, 2020, the Defendant administered philophones in a manner that inhales the smoke coming into and flowing from a string through a string with I, at the dwelling of the Defendant Fudio H in Suwon-si, Suwon-si, Suwon-si, the Defendant laid a philophone on the string.
