A Imprisonment with prison labor for one year, and for one year and six months, respectively.

However, from the date this judgment became final and conclusive, Defendant.

Punishment of the crime

Defendants are not authorized to handle narcotics, and thus, they shall not sell, deliver, or administer psychotropic drugs, psychotropic drugs (hereinafter referred to as 'clopon'; hereinafter referred to as 'copon').

1. 피고인들의 공동범행 피고인들은 C과 함께 필로폰을 판매하기로 공모하고, 피고인 B은 2020. 9. 7.경 서울 구로구 D모텔에서 필로폰 합계 약 3그램이 들어있는 비닐봉지 5개를 피고인 A로부터 받은 다음 서울 금천구 E건물 F호 C의 집으로 가서 C에게 건네주었고, G은 2020. 9. 7. 16:00경 위 C의 집에서 필로폰 약 3그램을 건네받은 다음 피고인 A에게 위챗 메신저를 통해 75만원 상당을 위안화로 송금하였다.

Accordingly, the Defendants conspired with C to sell and purchase phiphones.

2. Defendant A

A. On October 2020 from 17:00 to 18:00, the Defendant received philophones without compensation from K which had been living in the same building J around the Defendant’s dwelling gate of Guro-gu Seoul Metropolitan Government H building I and received approximately 0.1g of philophones contained in plastic factoring from K which had been living in the same building J around the dwelling gate of the Defendant.

B. At around 19:00 on October 10, 2020, the Defendant administered opphones by inserting approximately 0.1g of opphones in the glass pipe in the Defendant’s dwelling at H building I, Guro-gu Seoul Metropolitan Government H building I, and taking them into the opphones as soon as possible to inhale the smoke that occurs by heating the opphones.

3. Defendant B

가. 필로폰 매매 피고인은 2020. 10. 초순 새벽경 위챗 메신저를 통해 연락한 성명불상의 필로폰 판매자에게 20만원을 송금하고, 위 성명불상자가 서울 금천구 L 번지불상 주택 3-4층 사이 복도 창문에 은닉하여 둔 필로폰 약 0.5그램이 들어 있는 비닐팩을 가지고 가 필로폰을 매매하였다.

B. On October 14, 2020, the Defendant, who administered philophones, puts the philophones volume purchased into a glass pipe in the NKazop vehicle parked in the vicinity of the Ma of Ansan-si, Ansan-si, Ansan-si.
