A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On May 30, 2013, the Defendant was sentenced to imprisonment with prison labor for larceny, etc. in the Daegu District Court Kimcheon Branch on May 30, 2013 and completed the execution of the sentence in the Daegu Detention House on December 4, 2013.
around June 25, 2015, the Defendant: (a) contacted the victim C, who was posted a letter of intent to purchase the NAVC from the PC bank in order to access the PC from the PC bank in order to purchase the PC in order to send 45,000 won to the victim even if he/she received the money from the said victim; (b) provided that even though he/she did not intend to send the money from the said victim, he/she received 45,000 won from the said victim’s bank account (Account Number D) in the name of the said victim; and (c) provided that he/she received 45,000 won from the said victim to the Korean bank account (Account Number D) in the name of the said victim; and (d) transferred the money from June 25, 2015 to August 23, 2015 to the victim’s total sum of KRW 15,151,500,500.
around June 20, 2015, the Defendant called “2015 Highest 4772” that he would send computer parts to the victim E by communicating with the Internet NAVER car page at the PC bank located in the PC located in Osan-si, Osan-si, and by communicating with the victim E, who posted a letter to purchase the computer parts.
However, the defendant did not have any intention or ability to send computer parts to the victim because he did not have computer parts.
As such, the Defendant, by deceiving the victim, received 45,000 won in the name of the purchase price of goods from the post office account (Account NumberF) account under the name of the Defendant on the same day from that time.
8. Until 24.24. A total sum of 415,000 won was remitted from eight victims to the above account as the price for the goods in eight times in total, as shown in the list of crimes in attached Form (2).
