The punishment of the accused shall be determined by one year and six months.

Criminal facts

[Criminal Power] On August 22, 2019, the Defendant was sentenced to one year of imprisonment for a crime of fraud in the Busan District Court’s Vice-Support, and completed the execution of the sentence in the Incheon Detention House on April 1, 2020.

Around June 23, 2020, the Defendant posted an advertisement letter stating that “I will sell scamers after accessing the Internet J site using smartphones at the Defendant’s residence,” and that “I will send scamers on the scams at the scam to the victim D who reported the advertisement.”

However, in fact, the defendant did not have the above sker at the time, and there was only the idea that all of the money received from the victim will be consumed as living expenses, so there was no intention or ability to send the sker to the victim.

On June 23, 2020, the Defendant, by deceiving the victim as above, received 165,000 won from the victim D to the K account (L) under the name of the Defendant on June 23, 2020, and received 1,894,000 won in total from July 23, 2020 through the above 15 means, as shown in the attached crime list, from the time to July 23, 2020.

Around July 23, 2020, the Defendant posted an advertisement stating that “The sales of computer parts, such as the CPU, Medboard, etc., will send the computer parts if transferred,” to the victim M who reported and contacted, by using a smartphone at the Internet J site,” and read that “the transfer of proceeds is intended to send the computer parts if transferred.”

However, in fact, the defendant did not have the above parts at the time, and there was no intention or ability to send the computer parts to the victim, since he thought that all of the money received from the victim will be consumed as living expenses.

On July 24, 2020, the Defendant, by deceiving the victim as above, received 528,000 won from the victim to the N account (O) in the name of the Defendant.
