A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On August 16, 2019, the Defendant: (a) around 21:20 on August 16, 2019, at the 103 room of “D” for the operation of the Victim C in Jung-gu Seoul, Jung-gu, and the first underground floor; (b) under the influence of alcohol, the Defendant laid down micro-owneds owned by the victim and damaged them so that the repair cost would amount to KRW 220,000.

2. 공무집행방해 피고인은 2019. 8. 16. 21:47경 제1항 기재 ‘D’ 주점 앞 노상에서, 제1항 기재와 같이 소란을 피워 112 신고를 받고 현장에 출동한 서울남대문경찰서 E파출소 소속 순경 F로부터 귀가 조치를 받은 후, 갑자기 F이 타고 온 순찰차의 조수석 뒷좌석 문 부분을 붙잡고 순찰차가 출발하지 못하게 하는 등 행패를 부리고, 이를 제지하는 F에게 “씹할놈! 죽여 버린다!”라는 등으로 욕설하며 주먹을 휘두르고, 이후 공무집행방해죄 등의 현행범인으로 체포되면서 발로 F의 팔 부위를 1회 찼다.

Accordingly, the defendant assaulted F and interfered with the legitimate execution of duties of police officers on the prevention, suppression and investigation of crimes.

3. On August 17, 2019, around 01:15, the Defendant damaged public goods, as described in paragraph (2), was arrested in flagrant offenders, and detained in one internment room at the detention room of the Seoul Southern-gu Police Station, Seoul. Accordingly, the Defendant damaged the connection and device of the entrance, which is a thing used by public offices, thereby impairing its utility.
