1. The defendant shall be punished by imprisonment for eight months;
2.Provided, That the execution of the above sentence shall be suspended for two years from the date this judgment becomes final and conclusive;
Reasons
Punishment of the crime
The defendant is a inside director of D Co., Ltd. (Co-representative E, F) with the second floor of Busan Jung-gu C building.
1. Around February 29, 2012, the Defendant submitted a written complaint to the effect that “F, E, who is a joint representative director, prepares the minutes of the board of directors’ meeting, minutes of the general meeting, etc. at the Busan Central Police Station located in Yongsan-dong, Busan, and arbitrarily affixs a forged seal irrelevant to the Defendant’s name and affixed it to the Defendant at his/her discretion,” and on March 21, 2012, the Defendant made a statement with the same purport at the same police station.
However, in fact, the Defendant received a request from F to change a seal imprint in order to prepare the minutes of the board of directors meeting, and the Defendant had the same seal imprint as the Defendant himself, and agreed to prepare the said minutes, and filed a false complaint and filed a false complaint with F and E.
2.
